Dispute Resolution Services (DRS) : Types of Cases : Pre-Marital Agreements

Often referred to as an “antenuptial” or “prenuptial” contract, a pre-marital agreement can be an effective tool for individuals who are contemplating marriage.  Under the law, marriage is a contract.  Most contracts have several provisions about what would happen if the contract ends.  Unfortunately, many people fail to consider what might happen to their finances, property and children if their marriage comes to an end.

Through the mediation of a pre-marital agreement, clients can discuss and agree upon such terms.  They learn about their rights and responsibilities in the event of a separation, divorce or death of one spouse.  The pre-marital agreement may give each partner peace of mind about division of assets, allocation of income and financial stability in the event that the marriage ends. Pre-marital agreements are beneficial for most couples, but especially for those with children from a prior relationship or where there is a significant disparity in income or assets going into the marriage.
