At DRS, we can assist our clients and/or their attorneys in selecting the most appropriate ADR process(es) for their case, or in creating their own process. Our goal is to combine your needs with our skills to provide the most cost-effective and personalized resolution.
The correct process for a given case depends upon the particular facts of the case, personalities and desires of the parties, level of conflict, any legal issues, and many other factors.
Sometimes parties choose to use the same DRS professional for their entire case. Others may choose to use different processes and different providers for different parts of their case. Here are just a few examples of how that might work:
- Use one DRS mediator for parenting (with or without a neutral child specialist) and a different DRS mediator for financial matters.
- Use a mediator, plus a different DRS neutral (or an outside expert) to provide an evaluation of the financial situation, or even decide the financial matters in the unlikely event that mediation fails.
- Use a neutral accountant to value a business interest or run cash flow projections to be used in a DRS mediation process.
- Agree, in mediation, on everything except one topic and ask a DRS professional (or outside expert) for a decision on that topic.
- Use phone conferences, conducted inside or outside of mediation sessions, with persons in possession of information to obtain missing information, clarify the facts, and/or address concerns about facts.
